How do I get a restraining order in New Jersey?

Apply at the Family Division of the Superior Court in your county, or at your local police department when the court is closed. If a judge finds an act of domestic violence and a need for protection, a Temporary Restraining Order can be issued the same day.

What is the difference between a TRO and an FRO?

A Temporary Restraining Order is emergency and short-term, granted without the other party present. A Final Restraining Order is entered after a hearing where both sides testify, normally scheduled within ten days. In New Jersey a Final Restraining Order does not expire.

What must be proven at a final restraining order hearing?

Under Silver v. Silver the court must find that a predicate act of domestic violence occurred, and that a restraining order is necessary to protect the victim from immediate danger or further abuse. Both parts must be established by a preponderance of the evidence.

What does a Final Restraining Order do?

It bars contact and communication, can remove the defendant from a shared home, and may address temporary custody, parenting time and support. It also results in fingerprinting, entry in a statewide domestic violence registry, and a prohibition on possessing firearms.

What if I have been falsely accused?

Take it seriously and prepare thoroughly. A Final Restraining Order in New Jersey is permanent, restricts firearm rights and appears on record checks. The hearing is the one opportunity to present messages, call logs, witnesses and context, and an unprepared defendant is at a significant disadvantage.

Can a restraining order be dismissed?

A plaintiff may ask the court to dissolve one, and the judge will examine whether the request is genuinely voluntary. A defendant may apply under Carfagno v. Carfagno, which weighs the victim’s consent, any continuing fear, the defendant’s conduct since, and the passage of time.
